GENERAL TERMS AND CONDITIONS
The terms and conditions set forth below are in continuous effect for all GPL Money Transfer transactions. These terms and conditions apply to/govern You as a “User”, and your access to the use of GPL’s services (as specifically stated below). You may refuse to use the GPL services if you do not agree to be bound by such terms and conditions.
“MONEY TRANSFERS RELATING TO MONEY LAUNDERING, ILLEGAL GAMBLING ACTIVITIES, AND SUPPORT FOR TERRORISM IS A VERY SERIOUS OFFENCE UNDER MALAYSIAN LAW AND OTHER GOVERNING LAWS.”
1. MONEY TRANSFER SERVICE
GPL provides the service of money transfers to designated beneficiaries thereof in many countries around the world. In order to use this Service, a Money Transfer Request Form must be completed in full with the full name of the sender, current address, and telephone number. The Beneficiary/Recipient name must be as it appears on their VALID identification and that of the foreign country, where payment to the Beneficiary is to be effected. GPL reserves the right, in its sole discretion, to: (i) reject a proposed Money Transfer, (ii) limit the amount of a Money Transfer, (iii) require additional information to complete a Money Transfer, and/or (iv) take reasonable measures in complying with applicable laws and regulations with regard to the prevention of a Money Transfer relating to money laundering, illegal gambling activities and support for terrorism, and (v) prevent any violation of the Terms and Conditions of use. When required by applicable law, money transfers will be reported to concerned authorities. GPL will cooperate with law enforcement in the prosecution of illegal activities to the full extent permitted by applicable laws. You will be required to provide GPL with certain information to allow us, among other things, to verify your identity and source of funds to be transferred. You agree that the information you provide is current, and, not false, inaccurate or misleading. GPL assumes no obligation to make payment of the money transfer or to complete the applicable money transfer transaction if GPL does not receive the required documents supporting the transaction. GPL will not be held responsible for goods and/or services provided by the collecting agents of GPL’s affiliates. GPL reserves the right to refuse to provide the Services to you, at any time, for any reason deemed necessary to protect GPL’s interests. After GPL has completed the screening for proper compliance with the various applicable laws and regulations, the funds are promptly made available to the Beneficiary for pick up, or deposit into the Beneficiary’s bank account. The speed of payment of a Money Transfer varies depending on a variety of factors, including but not limited to, the amount of the transaction, the restrictions of the destination country or point of payment, and/or the accuracy of the information provided by the user. Money Transfers will normally be paid to the Beneficiary by cash or check (or a combination of cash or check depending on the availability of currency or other conditions existing at the point of payment).
2. CUSTOMER DUE DILIGENCE
As required by the mandatory remittance regulations, GPL customer service will conduct Customer Due Diligence to use GPL remittance service for any amount of remittance. CDD includes obtaining valid government-issued Identification with photograph, name, DOB, nationality, purpose of remittance, contact details, full address of sender and receiver details, and receiver ID based on the internal policy of the company. Customer Service may at any time implement any security and/or other check procedures deemed necessary for existing customers to update their records. CDD will also implement the verification of the identity of all parties related to the transaction in accordance to the various applicable laws governing it. The company reserves the right to reject accept or payment instruction if minimum CDD information are not provided for user registration. 3. FEES
In consideration for the use of this service, you agree to pay GPL a fee for each money transfer initiated by you at the applicable rate in effect, termed the “transfer fee”. The applicable transfer fee for your Money Transfer transaction will be provided to your application form prior to your final authorization of the transaction, in addition to any applicable fees for additional services. GPL reserves the right to change the fee schedule from time to time, where deemed necessary.
4. CURRENCY (FOREIGN) EXCHANGE
The foreign exchange rate will be applicable as stated in the customer receipt when conducting by sender. You agree that payment will be made to the stated Beneficiary/Recipient in the local currency of his/her country. GPL will not be held responsible for any violation of this rule by GPL’s Affiliates (and/or their paying Agents). The company will update rates to its Rate Display Board time to time without prior notice hence the user to ensure to check and confirm with customer service before you confirm to process.
5. CANCELLATION AN REFUNDS
Cancellation and Refunds will only be made upon confirmation that the applicable “faulty” Money Transfer transaction is not the fault of the User. Any Refunds for the principal Money Transfer amount, and subsequent cancellation of the underlying transaction, will be made upon the User’s valid written request if payment of the Money Transfer has not yet been made to the Beneficiary at the time the refund request is processed by GPL. To stop a payment, GPL will first check with its paying correspondent to determine whether payment of the Money Transfer has been made to the Beneficiary. If GPL can confirm that payment has not been made, the funds will be returned and GPL will refund such amount to the user, less any applicable fees and/or service charges. In cases where the Money Transfer funds were not made available to the Beneficiary within the time frame specified by GPL for the service, subject to the regular business hours at the Money Transfer destination/location, GPL shall refund the Money Transfer amount and transfer fee within seven (7) business days after receipt of the user’s written request to refund the same. Should such a refund be delayed for any reason, GPL will notify the respective User(s). If payment is executed to wrong account no cancellation and refund will be accepted hence the user to check and ensure correct details of recipient before your sign the application form.
6. CHARGES FOR CANCELLATION OF TRANSACTION
Based on the information you supplied to us on the Money Transfer Request Form, you agree that the charges for a cancellation of transaction will have to be paid to our collecting agent, as specified by GPL, upon your request for a cancellation of a Money Transfer. You agree that for every cancellation made to a specific transfer, such charges will apply if the cancellation is due to your fault or request.
7. DISCLAIMER OF WARRANTIES
The service provided to you by GPL will be on an “as is” and “as available” basis. You explicitly agree that your use of the service is at your own risk. No warranty, representation, condition, undertaking or term- express or implied, statutory or otherwise, including but not limited to the condition, quality, durability, performance, accuracy, reliability, non-infringement, merchantability, or fitness for a particular purpose or use of the service is given or assumed by GPL; all such warranties, representations, conditions, undertakings and terms are hereby expressly excluded. GPL makes no warranty that the service will meet your requirements, or that the service will be uninterrupted, timely, secure, or error free.
8. LIMITATION OF LIABILITY
In no event shall GPL be liable to anyone for any delays, non delivery, nonpayment, inaccuracies, errors or omissions with respect to the service or the information or the transmission or delivery of all or any part thereof, for any damage arising therefrom or occasioned thereby, or for the results obtained from the use of information available on or through the service. These conditions cannot be changed or supplemented orally.
9. DISPUTES RESOLUTION
Any related dispute or claim arising from the service and/or the Terms and Conditions, including any dispute or claim regarding the applicability of the provisions, shall be settled by binding arbitration. Complaints that cannot be resolved through GPL’s complaint handling procedure may be resolved through GPL’s Dispute Resolution procedure. This process is open to all GPL members and licensees. GPL’s dispute Resolution procedure is entirely voluntary and will only occur when both GPL and the GPL member or licensee agrees to have the dispute resolved through this procedure. The procedure established by GPL is for dispute resolution via a decision from an independent expert (Arbitrator). Choosing the expert is a collaborative effort between both parties. Each party nominates two candidates who are knowledgeable in copyright issues. The parties will then jointly choose an expert from these four candidates. GPL has a complaints handling procedure which aims to resolve issues promptly. If a complaint is not resolved during this process, then it may be referred to the Dispute Resolution Procedure. Only those disputes that have first been through GPL’s Complaints Handling Procedure may be referred to a Dispute Resolution Procedure.
10. GOVERNING LAW AND JURISDICTION
The GPL Terms of Service, including these Terms of use, shall be governed by, and construed in accordance with, the laws of Malaysia without regard to conflicts of laws principles. All matters, whether sounding in contract, tort or otherwise, relating to the validity, construction, interpretation or enforcement of this Terms and Conditions shall be determined by the laws of Malaysia.
11. GPL REMITTANCE PRIVACY POLICY
GPL may disclose the personal information to applicable authorized third parties (e.g., Bank Negara Malaysia, The Police etc. upon approval from regulator), in their request for particular information under their enquiry. Information disclosed may include your financial background, your contact information, your identification, information about your transactions with us and other information relating to financial matters. You may limit our affiliates from marketing their products or services to you based on your personal information given in your money transfer transaction(s) done. Your choice to limit certain disclosures ( eg. Limited to marketing offers from our Affiliates), will apply until your request to change your choice is officially received by GPL or your data has been deleted from our system under proper reasons and authorized procedures. 12. POLICY ON ANTI-BRIBERY & CORRUPTION
The company strictly adhere Zero tolerance on Bribery & Corruption hence; the GPL user/s requested not give any benefits, gift, cash or cash equivalent to obtain the service of GPL. The ABC Policy is applicable to all directors, employees, part time workers, GPL Customers, Corresponding agents, employees from any corresponding agents, vendors, contractors, suppliers, dealers, service providers, consultants, and individuals who perform work or services for GPL Remittance.
13. BUSINESS DAYS AND WORKING HOURS
The business days are 360 Days for minimum 8 hours, operation hours will be based on the branch locations. Operation hours might change time to time and displayed Infront door of each branch. Notice of office closer will be displayed at least 24 hours before for such closer of branches.
